This agreement together with any additional terms, conditions, notices and disclaimers contained elsewhere within the CareerNavigator software and on the JIIG-CAL Australia site form the conditions of supply of material on, use of and access to CareerNavigator software and the JIIG-CAL Australia site.

JIIG-CAL Australia may modify this agreement at any time, and such modifications shall be effective immediately upon posting of the modified agreement.

Please read this agreement carefully before accessing or using Career Voyage software or the JIIG-CAL Australia site. Accessing or using Career Voyage software or the JIIG-CAL Australia site,constitutes an affirmation, acknowledgment and agreement by you that you accept and agree to abide and be bound by these conditions and modifications.

Should you object to any of these conditions or any subsequent modifications your only recourse is to immediately discontinue your use of the Career Voyage software and the JIIG-CAL Australia site.

1. PURPOSE
Career Voyage is designed to be used as an aid or tool to assist individuals to make good career choices. It enables exploration of personal and job factors relevant to career decision-making, helps clarify suitable career opportunities, establishes guidelines for exploration of relevant occupational information, and facilitates realistic career planning.

The JIIG-CAL Australia site and Career Voyage software does not provide
(a) advertisements for actual job vacancies (or advertisements of any kind);
(b) searches for actual job vacancies;
(c) detailed labour market information;
(d) detailed information on educational institutions, vocational and training courses or vacancies.

2. ACCURACY OF INFORMATION
JIIG-CAL Australia makes every effort to ensure that all material on the JIIG-CAL Australia site and within the Career Voyage software is accurate and up to date. All material is derived from sources believed to be accurate and current as at the date of publication. However occupational information changes very rapidly.

The purpose of the information provided is to assist realistic career planning. The information is intended to provide general information and does not represent personal, professional advice. Any illustrations or photographs displayed on this site are solely for guidance and are not to be relied upon.

JIIG-CAL Australia does not warrant that the information provided will be error-free or that defects in the software will be corrected.

3. ACCESS TO INFORMATION
While your record is active JIIG-CAL Australia will take all due care to store your information to allow you to resume at any time where you leave off.

Each client record is under the direct control of a personal Career Adviser, and JIIG-CAL Australia therefore does not warrant that information will not be deleted or there will not be a failure to store user information. JIIG-CAL Australia does not warrant that the information provided will be error-free or that defects in the software will be corrected.

In the unlikely event of such failure, please contact JIIG-CAL Australia and we will endeavour to rectify the situation.

JIIG-CAL Australia strongly recommends that users discuss Career Voyage reports and related personal circumstances with a professional career counsellor.

JIIG-CAL Australia does not warrant that your access to the Career Voyage software or JIIG-CAL Australia site will be uninterrupted, timely or secure including but not limited to computer or communications link down time attributable to malfunction, upgrades or preventative or remedial maintenance activities.

All care has been taken to ensure that CareerVoyage.com.au has sufficient security in place to provide you with safe, private usage of this website, and that software we provide is free of viruses, worms, and other malicious programs. However, JIIG-CAL Australia does not warrant that files available for downloading from the Career Voyage software or through the JIIG-CAL Australia site or delivered via electronic mail through the JIIG-CAL Australia site will be free of infection or viruses, worms, Trojan horses or other code that manifest contaminating or destructive properties.

JIIG-CAL Australia has provided a 128-bit encryption to ensure that the privacy and integrity of data you provide us with is maintained. However, a remote possibility does exist, as it does on every other, that this information can be unlawfully interpreted and recorded by a third party whilst this information is in transit over the Internet, or while stored on JIIG-CAL Australia systems. This is very unlikely. However in the remote case that the integrity of your information is compromised, JIIG-CAL Australia accepts no liability.

These websites do not form part of the JIIG-CAL site or the Career Voyage software nor are they under the control of neither JIIG-CAL Australia nor its related bodies corporate.

Neither JIIG-CAL Australia nor its related bodies corporate are responsible for the contents (including the accuracy, legality or decency) of any hyperlinked site or any hyperlink contained in a hyperlinked site.

JIIG-CAL Australia is not responsible for either copyright or privacy legislation compliance of any hyperlinked site.

JIIG-CAL Australia does not monitor or exercise editorial control over hyperlinked sites and services. JIIG-CAL Australia reserve the right to access or examine any hyperlinked site or services and at their absolute discretion, to move, remove, permanently delete or disable access to and hyperlinked site or service which is in breach of any law or considered by JIIG-CAL Australia to be otherwise unacceptable.

In using or continuing to use the Career Voyage software and JIIG-CAL Australia site you may give us information which is capable of identifying you.

By using the Career Voyage software you grant JIIG-CAL Australia the right to use your personal information in accordance with the aims of the site, while at the same time respecting your rights and your status as our valued client.

Subject to the de-identification of the information you agree that JIIG-CAL Australia may reproduce, distribute, transmit, create derivative works of, and publicly display any materials and other information (including ideas for new or improved products and services) that you submit or email within the Career Voyage software or on the JIIG-CAL Australia site. You agree to not use, submit or transmit any material of any kind which violates or infringes upon the rights of any other person, including material which is an invasion of any privacy or publicity rights or which is protected by copyright, trade mark or any other proprietary right, or derivative works with respect thereto, without first obtaining permission from the owner or relevant right holder.

Furthermore you agree not to not use, submit or transmit any material of any kind which is illegal or defamatory and will not expose JIIG-CAL Australia to any civil or criminal liability.

6. PASSWORD AND LOG IN SECURITY
To become a registered user, you are provided with a username and password. You may change these at any time.

You agree to immediately notify JIIG-CAL Australia of any unauthorized use of your username or any other breach of security known to you.

JIIG-CAL Australia does not warrant the privacy of your information if you do not maintain the confidentiality of your username and password.

You are solely responsible for any and all activities that occur under your username

7. COPYRIGHT
Material within the Career Voyage software and the JIIG-CAL Australia site including, without limitation, software, documents, text, images and codes, are subject to copyright and other intellectual property rights. It is intended for your personal use and must not be used for any purpose that is unlawful or prohibited by these terms of use.

You may view, copy and print the Material in electronic or other forms only for personal use. If you do, you must retain and copy in full all Intellectual Property Rights notices on the original Material. You may not delete any author attributions, legal notices or proprietary designations or labels in any file that is uploaded.

You must not under any circumstances copy, distribute or use the material contained on the JIIG-CAL Australia site or in the Career Voyage software for public or commercial purposes except with the written agreement of JIIG-CAL Australia.

You must not infringe the Intellectual Property Rights of JIIG-CAL Australia and/or their licensors, including by amending or adapting any Material or reverse engineering any Material consisting of software or associated algorithms.

You may not use any part of the material on the Career Voyage software or the JIIG-CAL Australia site to establish, maintain or provide, or assist in establishing, maintaining or providing your own publications, Internet site or other means of distribution.

Nothing you do on or in relation to the Career Voyage software or the JIIG-CAL Australia site will transfer any Intellectual Property Rights to you or license you to exercise any Intellectual Property Rights unless this is expressly stated.

8. LIMITING LIABILITY
Use of the Career Voyage software or the JIIG-CAL Australia site is at your own risk. All express or implied warranties, representations, statements, terms and conditions relating to your use of the Career Voyage software or the JIIG-CAL Australia site or any information or content available from the Site, not contained in these Terms and Conditions, are excluded from these Terms and Conditions to the extent permitted by law.

Nothing in these Terms and Conditions excludes, restricts or modifies any condition, warranty, right or remedy implied or imposed by any statute or regulation which cannot lawfully be excluded, restricted or modified, which may include Part V of the Trade Practices Act 1974 of the Commonwealth of Australia and corresponding provisions of State or Territory of Australia legislation which contain provisions including implied terms and warranties which operate to protect the purchasers of goods and services in various circumstances.

If any condition or warranty is implied into this agreement under the Trade Practices Act 1974 of the Commonwealth of Australia or any equivalent State or Territory of Australia legislation and cannot be excluded, and JIIG-CAL Australia is able to limit your remedy for a breach of such a condition or warranty, then the liability of JIIG-CAL Australia for breach of the condition or warranty is limited to, at JIIG-CAL Australia's option, supply of the services again, or the payment of the cost of supplying the services again.

9. GST
Unless stated to be otherwise, charges referred to for use of any services provided by JIIG-CAL Australia are GST inclusive (as these terms are defined in A New Tax System (Goods and Services Tax) Act 1999 of the Commonwealth of Australia).

Where GST applies, upon payment for online credit, JIIG-CAL Australia will deduct the GST it incurs from each payment and JIIG-CAL Australia will issue the customer with a Tax Invoice. Each invoice will comply with the form of 'tax invoice' specified in section 29-70 of A New Tax System (Goods and Services Tax) Act 1999 of the Commonwealth of Australia and the Regulations issued in accordance with that Act of the Commonwealth of Australia.

10. DISCLAIMER
The Career Voyage software and the JIIG-CAL Australia site and any right or obligation under these Terms and Conditions is governed by the laws in force in the State of Western Australia, Australia (other than the conflict of laws rules) and the parties submit to the non-exclusive jurisdiction of the courts of the State of Western Australia, Conditions is governed by the laws in force in the State of Western Australia, Australia (other than the conflict of laws rules) and the parties submit to the non-exclusive jurisdiction of the courts of the State of Western Australia, Australia in respect of any action that arises under the agreement.
